Terms of Service

These Terms of Service govern your use of Prospectlab, which is operated by Designbite Ltd, a company registered in England and Wales (company number 10223220), with its registered office at 26 Altenburg Avenue, London W13 9RN ("we", "us"). By creating an account you agree to these Terms. If you do not agree, please do not use the service.

Prospectlab is a business-to-business outreach platform. You can upload lists of business prospects, generate personalised email sequences using our deterministic generation engine with AI-assisted personalisation, and push those sequences to a connected sending tool such as Smartlead. Prospectlab does not send email on your behalf; sending happens through the tool you connect. We may improve, change or withdraw parts of the service, and will give you reasonable notice of any significant change.

You must give accurate information when you create an account and keep it up to date. You are responsible for keeping your login details secure and for everything done under your account. Tell us straight away at martin@prospectlab.ai if you think someone has accessed your account without permission.

You may use Prospectlab only for lawful business-to-business outreach. You must not:

upload consumer (B2C) personal data, or data about people you have no lawful basis to contact
send spam, phishing or deceptive messages
reverse-engineer, scrape, or otherwise abuse the platform or its interfaces
resell or sublicense the service without our written permission
upload content that infringes someone else's intellectual property

You are responsible for making sure your own outreach complies with the laws that apply to you and to the people you contact, including UK GDPR, the Privacy and Electronic Communications Regulations, the CAN-SPAM Act and CASL.

You own the prospect data and content you upload. You grant us a limited licence to process it so we can provide the service. For data protection: you are the controller of your own targeting and sending decisions, and we are the controller of the processing we decide on, such as enrichment; our Privacy Policy explains this. If we become aware of a personal data breach affecting your data, we will tell you without undue delay.

Free trial: new accounts get a 14-day free trial. No card is required to start it. When the trial ends, your account moves to read-only access until you choose a paid plan; we do not charge you automatically.
Plans: we offer three subscription tiers, each available monthly or annually and billed in advance.
Usage charges: enrichment is metered and charged based on use, and you can buy credit packs for discovery, verification, enrichment and signals. Credits are used oldest-first and may expire.
Cancellation: you can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then. We do not give pro-rata money refunds for unused time.
Bounced prospects: if a prospect's email bounces, we restore the usage credit for it if you tell us within 30 calendar days. This is a credit, not a money refund.
Price changes: we will give you 30 days' notice of any price change.

Prospectlab and its underlying technology, design and content belong to Designbite Ltd. These Terms give you a limited right to use the service and transfer no other intellectual property rights to you. You keep ownership of your own data.

The service is provided "as is". We do not warrant that it will be uninterrupted or error-free. Email content generated with AI is not guaranteed: you must review it before you use it, and we do not promise any particular delivery rate or result. You use the service at your own risk.

To the fullest extent the law allows, our total liability to you for any claim connected with these Terms or your use of the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential or incidental loss. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, for breach of our intellectual-property indemnity, or for anything else that cannot be limited under law.

We may suspend or end your account if you break these Terms, with or without notice depending on how serious the breach is. You may close your account at any time. When your account ends, we handle your data as set out in our Privacy Policy.

These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
